17px;">张再刚介绍，新修订的《认定办法》围绕适当放宽特困人员认定条件、切实兜住兜牢基本民生保障底线的目标要求，重点对认定特困人员无劳动能力、无生活来源、无法定义务人或法定义务人无履行义务能力涉及的部分条款进行了修订完善。</span></p><p style="text-align:justify;font-size: 14px;padding-right: 17px;">一是适度拓展了“无劳动能力”的残疾种类和等级。</span></strong></span><span style="font-size: 17px;">根据地方实践探索和现实需要，修订后的《认定办法》在原有认定“一、二级智力、精神残疾人，一级肢体残疾人”为无劳动能力的基础上，增加了“三级智力、精神残疾人，二级肢体残疾人和一级视力残疾人”，规定上述残疾人应当认定为无劳动能力。</span></p><p style="text-align:justify;font-size: 14px;padding-right: 17px;">认定特困人员“无生活来源”的具体条件是其收入应低于当地最低生活保障标准，且财产符合当地特困人员财产状况规定。根据中央加强优抚安置工作相关文件规定，修订后的《认定办法》明确优待抚恤金不计入申请人收入。同时，为准确规范界定申请人收入范围，将原表述“城乡居民基本养老保险中的基础养老金”修改为“中央确定的城乡居民基本养老保险基础养老金”。</span></p><p 39);"><strong><span style="font-size: 17px;">三是适度放宽了“法定义务人无履行义务能力”认定条件。</span></strong></span><span style="font-size: 17px;">为解决当前地方普遍反映的“以老养残”、“一户多残”等问题，修订后的《认定办法》在原认定范围的基础上，明确规定本人收入低于当地上年人均可支配收入，且财产符合当地低收入家庭财产状况规定的70周岁以上老年人、重度残疾人和残疾等级为三级的智力、精神残疾人，应当认定为无履行义务能力。</span></p><p style="text-align:justify;font-size: 17px;">四是适度放宽了特困人员救助供养制度覆盖的未成年人范围。</span></strong></span><span style="font-size: 17px;">落实中办、国办《关于改革完善社会救助制度的意见》“将特困救助供养覆盖的未成年人年龄从16周岁延长至18周岁”的要求，切实解决特困人员中的未成年人年满16周岁后面临的生活困难，维护未成年人的基本生活权益，修订后的《认定办法》明确“特困人员中的未成年人，可继续享有救助供养待遇至18周岁”；同时规定，“年满18周岁仍在接受义务教育或者在普通高中、中等职业学校就读的，可继续享有救助供养待遇”。此外，修订后的《认定办法》将调查核实和审核确认时限均由20个工作日压缩到15个工作日，并鼓励有条件的地方将审核确认权限下放到乡镇人民政府（街道办事处），进一步简化优化认定程序，缩短办理时限，确保困难群众能够及时、便捷地获得救助。</span></p><section
